Terms of Use

These Terms of Use ("Terms") are an agreement between you and Snoozy ("Snoozy," "we," "us," or "our"). They govern the Snoozy website, iOS application, and related services (the "Service").
Read these Terms before you use the Service. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. You must have legal capacity to accept these Terms. A parent or guardian must approve use where applicable law requires approval.
2. Accounts
You can use Sign in with Apple to create an account. Give us accurate information and keep your account secure. You are responsible for activity that occurs through your account.
Contact us at support@snoozy.jsj.sh if you suspect unauthorized account access. You can delete your account in Profile. Account deletion is permanent and removes the data described in our Privacy Policy.
3. The Service
Snoozy provides alarms, barcode stop codes, reminders, widgets, and alarm history. We can add, change, or remove features. We will give notice when a change materially affects paid access.
4. Alarm and safety limitations
Do not use Snoozy as an emergency alert, medical device, or safety system. Do not rely on Snoozy for medication, caregiving, travel, work, or another time-critical obligation.
An alarm can fail because of device power, volume, permissions, software, network access, or operating-system behavior. Make sure that your device has power and the required permissions. Use a backup alarm for an important obligation.
Snoozy provides general wellness and habit features. Snoozy does not diagnose, treat, cure, or prevent a disease or sleep disorder. Ask a qualified medical professional about a medical concern.
5. Subscriptions and billing
Some features require an auto-renewable subscription. The purchase screen shows the subscription period, current price, and included features before purchase.
Apple processes payments, renewals, cancellations, and refunds through your Apple ID. Your subscription renews unless you cancel it at least 24 hours before renewal. Manage or cancel the subscription in your App Store account settings.
Prices and taxes can change as permitted by Apple and applicable law. Apple or applicable law controls refund eligibility. Snoozy does not promise that all fees are non-refundable.
6. License and acceptable use
Snoozy gives you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service. You must obey these Terms and applicable law.
You must not:
- Copy, sell, lease, or distribute the Service.
- Reverse engineer the Service, except where applicable law permits it.
- Interfere with the operation or security of the Service.
- Access the Service through an unauthorized automated method.
- Use the Service to violate a law or another person's rights.
- Submit malicious code or false information.
7. Your content
You keep ownership of content that you submit, such as alarm labels. You give Snoozy a limited license to process that content. This license applies only when necessary to operate, secure, and support the Service.
8. Snoozy property
Snoozy and its licensors own the Service, software, design, trademarks, and content. Applicable intellectual-property laws protect these materials. These Terms do not transfer ownership to you.
9. Suspension and termination
You can stop using the Service at any time. You can delete your account in Profile.
We can suspend or end access if you violate these Terms or create a security risk. We can also act when law requires it. We will give notice when reasonably possible.
Sections that must continue by their nature remain effective after termination. These sections include ownership, disclaimers, liability limits, and dispute terms.
10. Disclaimers
Snoozy provides the Service "as is" and "as available." Snoozy does not guarantee uninterrupted or error-free operation of any feature.
To the maximum extent permitted by law, Snoozy disclaims all implied warranties. These warranties include merchantability, fitness for a particular purpose, title, and non-infringement.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, Snoozy is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. This exclusion includes missed alarms, lost opportunities, lost profits, and lost data.
Snoozy limits its total liability for all claims to the greater of $100 or your payments during the prior 12 months. This limit does not apply where applicable law prohibits it.
These limits apply regardless of the legal theory. They also apply if Snoozy knew that damages were possible.
12. Indemnity
To the extent permitted by law, you will indemnify Snoozy against claims caused by your unlawful use of the Service. This duty does not apply to claims caused by Snoozy.
13. Changes to the Service or Terms
We can update these Terms. We will post the new Terms and update the effective date. We will give notice before a material change takes effect when applicable law requires notice.
If you continue to use the Service after the effective date, you accept the updated Terms. If you do not accept them, stop using the Service and delete your account.
14. Governing law
North Carolina law governs these Terms, without regard to its conflict-of-law rules. This section does not remove rights that the law of your location gives you.
15. General terms
These Terms and the Privacy Policy are the entire agreement about the Service. If one provision is unenforceable, the remaining provisions continue in effect.
A failure to enforce a provision is not a waiver. You cannot assign these Terms without our consent. We can assign these Terms as part of a merger, acquisition, reorganization, or asset sale.
We are not responsible for a delay caused by events beyond our reasonable control. These events can include network failures, natural disasters, government action, and service-provider outages.
16. Apple terms
Apple is not a party to these Terms and does not provide the Service. Apple has no duty to provide maintenance or support. Apple is a third-party beneficiary of these Terms and can enforce this section.
